PRIVACY POLICY

§1. INTRODUCTORY REMARKS

1.       This privacy policy sets out the rules for the processing of data of Users of the rockforce.pl website available at www. rockforce.pl and accompanying services, including the contact form and newsletter, in particular personal data, as well as the rules for the use by the Service Provider of these services in connection with their provision of data entered into Users' end devices commonly known as cookies.

2. This data protection and cookie policy also constitutes the information referred to in Article 13(1)-(2) of Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as the GDPR)


§2. GLOSSARY OF TERMS

1.       Personal data controller – TRADE HOUSE FORSAGE INSTRUMENT POL Limited liability company with its registered office in Białystok, ul. Gródecka 1A, 15-561 Białystok, entered in the Register of Entrepreneurs of the District Court in Białystok, 12th Commercial Division of the National Court Register, under KRS number: 0000697874, NIP: 5423283539, REGON: 368280649 (hereinafter referred to as the “Administrator” or “TRADE HOUSE”)

2.       GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L 2016. 119.1) and corrigendum to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119 of 4.5.2016).

3.       USUDE – Act of July 18, 2002, on the provision of electronic services, i.e. of February 6, 2020 (Journal of Laws of 2020, item 344)

4.       PT – Act of July 16, 2004 – Telecommunications Law, i.e. of February 23, 2021 (Journal of Laws of 2021, item 576)

5. Cookies – IT data, in particular small text files, saved and stored on end devices, which can be read each time the device connects to the rockforce.pl Website, used to enable or facilitate Users' access to the Website

6.       Newsletter – an electronic form of a bulletin (magazine) sent by e-mail to subscribers, containing, among other things, information about the Website's offer, promotions, and competitions organized by the Administrator.

7.       Terminal device – an electronic device, such as, in particular, a computer set or mobile phone through which the User accesses the Website;

8.       User – any person who uses the rockforce.pl Website in any way.

9.       Website – the www.rockforce.pl website.


§3. GENERAL PROVISIONS

1.       The administrator of personal data collected via the Website www.rockforce.pl is TRADE HOUSE FORSAGE INSTRUMENT POL Limited Liability Company with its registered office in Białystok, ul. Gródecka 1A, 15-561 Białystok – hereinafter referred to as the “Administrator” or “TRADE HOUSE”.

2. Personal data collected by the Data Controller is processed in accordance with the provisions on the protection of personal data, in particular the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Polish regulations issued in connection with the GDPR, including the provisions of the Act of May 10, 2018, on the protection of personal data (Journal of Laws of 2018, item 1000). The data controller keeps personal data confidential and protects it from unauthorized access by third parties in accordance with the rules set out in the above-mentioned legal acts.

1.       As part of its activities, the Administrator collects and processes personal data on the following legal bases:

A.      on the basis of the consent of the data subject for the purpose of processing such data in connection with the provision of services on the rockforce.pl website (legal basis: Article 6(1)(a) of the GDPR);

B.      in order to fulfill the legal obligations incumbent on the Administrator, in particular obligations in the field of financial reporting and related to the investigation or possibility of pursuing civil law claims or criminal or administrative liability by the Administrator, User, or third parties (legal basis: Article 6(1)(c) of the GDPR);

C.       to the extent that the User has consented to receive commercial information for advertising and marketing purposes (legal basis: Article 10 of the USUDE and Article 172 of the PT). 


§4. NEWSLETTER SUBSCRIPTION

1.       Providing your email address and accepting the subscription in the Order Form is tantamount to consenting to the processing of personal data related to the newsletter service. The subscription does not require you to provide any personal data (except for the aforementioned email address).

2.       The newsletter sent to the email address registered by the user contains information related to the TRADE HOUSE offer.

3.       Receiving the newsletter is free of charge.

4. Each email has a footer with a link that allows the User to unsubscribe. Unsubscribing is tantamount to opting out of receiving further messages.

5. TRADE HOUSE does not send messages commonly considered to be “spam.” The User receives messages only after prior registration and account activation, which excludes the possibility of another person registering the same email address.

6. TRADE HOUSE does not disclose entrusted email addresses to third parties.


§5. TRANSFER OF PERSONAL DATA TO THIRD PARTIES

1. In accordance with the rules set out in the provisions of law on the protection of personal data and within the scope provided for therein, each User has the right to access their personal data, the right to rectify/correct, delete or restrict the processing of such data, and the right to transfer such data.

2.       The User has the right to lodge a complaint regarding the processing of their personal data by the Administrator with the President of the Personal Data Protection Office.

3. Personal data will be processed no longer than, respectively, until the legitimate interests pursued by the Administrator as the data controller related to the processing of specific data are fulfilled, until the expiry of the limitation periods related to the contract to which the processing of personal data is related, or related to the expiry of obligations under the law.

4. Users' personal data is processed by the Administrator itself and may be transferred to the following recipients:

A. providers of tools for analyzing traffic on the Website, conducting marketing activities on it, and sending newsletters (including Google Analytics, Google Search Console, Microsoft Clarity, Mailchimp);

B.      entities cooperating directly with the Administrator, i.e., marketing agencies with which the Administrator has a contract and/or transport companies providing delivery services to TRADE HOUSE customers.


§6. INFORMATION ABOUT COOKIES.

1.       The Website uses cookies. 

2. Cookies are IT data, in particular text files, which are stored on the Website User's end device and are intended for use on the Website's pages. Cookies usually contain the name of the website they come from, their storage time on the end device, and a unique number.

3. The entity placing cookies on the Website User's end device and accessing them is the Website operator.

4. Cookies are used for the following purposes:

A. creating statistics that help understand how Website Users use websites, which allows improving their structure and content;

B.      maintaining the Website User's session (after logging in), thanks to which the User does not have to re-enter their login and password on every subpage of the Website;

C.       determining the user's profile by Google in order to display tailored content in advertising networks.

5.       The Website uses two basic types of cookies:

b.       Encrypted session hash (user security)

c.       Browser identifier (for statistical purposes)

e.       Shopping cart support in the online store

6. Web browsing software (web browser) usually allows cookies to be stored on the User's end device by default. The web browser allows cookies to be deleted. 7.       Restrictions on the use of cookies may affect some of the functionalities available on the Website.

8.       Cookies placed on the Website User's end device may also be used by advertisers and partners cooperating with the Website operator.
